Valencian act

Valencian act 9/2003 of 2 April for equality between men and women, provides as a means of promoting equality to encourage enterprises to carry out a Plan of equality through the granting of aid, delimiting and demanding as a condition for its acquisition, which it is verified and approved by the competent autonomous Government in the field of women.
In addition, this Act determines that companies or organizations participated mostly with public capital are required to the elaboration of a plan for equality.

National Acts

Law 3/2007 of 22 March, for the effective equality of women and men, establishes that:

  • “Equality plans are an ordered set of measures, taken after a diagnosis of the situation, aimed to achieve equal treatment and opportunities between women and men, and to eliminate discrimination on grounds of sex”.
  • žThe obligation of all enterprises “respect equality of treatment and opportunity in the workplace…” taking “.. .measures to avoid any kind of discrimination in employment between men and women, measures which shall negotiate, and if agreed, the legal representatives of the workers… ‘.
  • žFor certain businesses, it makes it compulsory adoption of such measures through the implementation of equality plans in the enterprise. The companies forced the development of these plans are:
  1. Companies from more than 250 employees
  2. Companies with specific requirements
  3. Companies under a disciplinary procedure by the labour authority regarding equal opportunities

For the rest of companies, the development and implementation of equality plans is voluntary. Nevertheless, the adoption of measures aimed at avoiding any kind of employment discrimination between women and men is a general requirement for all companies.

Intervention areas

Act 3/2007 recommends the implementation of these measures in a few priority areas. These areas are:

  1. EQUALITY IN ACCESS TO EMPLOYMENT AND RECRUITMENT.
  2. EQUALITY IN VOCATIONAL CLASSIFICATION, PROMOTION AND TRAINING.
  3. EQUALITY IN REMUNERATION.
  4. ORGANISATION OF WORK-LIFE BALANCE.
  5. SEXUAL HARASSMENT AND DISCRIMINATION.
